PROCESS SERVING
The service of process also known as Writ of Process is defined as a formal document, authorized by law, directed to a person, commanding him/her to do or refrain from doing some act. The purpose of process is to notify the subject that he/she is being sued, the nature of litigation, and to confer jurisdiction of the court over the subject person.
Types of Process Service
Personal - a physical delivery, of a copy of the process, to the person being served.
Substituted - a physical delivery to someone other than the intended subject who is authorized by law or contract to be served for the original subject.
Constructive - is made by mailing a copy of the process to a subject and by publishing notice in a qualified posting area required by law.
Proof of service is required. The court cannot proceed in the action until proof of valid service has been made.
